A. That Recommendation E of the report titled Flood Resilient Homes (Voluntary Buy Back Program) – Proposed Property Purchase/Acquisition Report presented and endorsed at the Special Council Meeting on 28 March 2023 (Special Council Meeting Report
28 March 2023), be amended to replace “being authorised by the Queensland Reconstruction Authority, as fully reimbursable to Council under the Resilient Homes Fund” with “being authorised by the Queensland Government as fully reimbursable to Council through funding made available by the Queensland Government” and to replace “which is not fully reimbursable under the Resilient Homes Fund” with “which is not fully reimbursable through funding made available by the Queensland Government”.
B. That upon adoption of the amendments contained in Recommendation A of this report, and in accordance with the amended Recommendation E of the Special Council Meeting Report dated 28 March 2023:
(i) Council receives and notes the letter from the Queensland Government (contained in Confidential Attachment 3) that confirms items not covered by the Resilient Homes Fund will be met by funding made available from the Queensland Government (up to the amount of $1.84 million); and
(ii) Council confirms that it is satisfied that sufficient funding is available from the Queensland Government to progress with the acquisition of these properties.
C. That Council notes that the next steps to proceed with the purchases/acquisitions of these properties is for QRA to commence valuations.

Nicholas Street Precinct - Approval of a Lease for Ground Level Eats Tenancy T2 (25 Nicholas Street)

A. That Council enter into a Lease (and any ancillary documentation) with the proposed lessee of the Ground Level Tenancy T2, Eats Building, 25 Nicholas Street (impacting Lot 1 SP307972, Lot 2 RP209886 and Lot 3 RP212242) (“Ground Level Tenancy T2”) within the Nicholas Street Precinct (under the commercial terms detailed in the confidential report and attachments by the Project Manager dated
8 September 2023).
B. That Council note, that in relation to Council’s disposal of its leasehold interest in the Ground Level Tenancy T2 to the proposed lessee, that the Ministerial exemption under s236 (1)(f) of the Local Government Regulation 2012 applies to the disposal of Council’s interest in the Ground Level Tenancy T2 (Ministerial exemption contained in Attachment 1 of this report).
C. That pursuant to Section 257(1)(b) of the Local Government Act 2009, Council resolve to delegate to the Chief Executive Officer the power to take “contractual action” pursuant to section 238 of the Regulation, in order to implement Council’s decision at Recommendation A.
D. That Council be kept informed as to the progress and outcome of the execution and publication of details.
