Flood Resilient Homes (Voluntary Buy Back Program) - Proposed Property Purchase/Acquisition

A. That, subject to Recommendation E, Council resolve to purchase or where necessary, compulsorily acquire the properties listed in Confidential Attachment 1 for park purposes and/or other purposes as determined by Council.

B. That, subject to Recommendation E, in the first instance the method of purchase will be by agreement with the affected person/s via the voluntary home buy-back program guidelines and requirements; and pursuant to the Property Law Act 1974 .

C. That, subject to Recommendation E, for any compulsory acquisitions, in the first instance the method of purchase will be by agreement pursuant to the Acquisition of Land Act 1967 .

D. That, subject to Recommendation E, for any compulsory acquisitions, in the second instance Council, as “constructing authority” pursuant to Section 5(1)(b)(i) of the Acquisition of Land Act 1967 , will proceed to acquire the subject land.

E. That Council make the recommendations contained in paragraphs A – D (above) subject to, and strictly conditional upon the eligible expenditure identified in Confidential Attachment 5 being authorised by the Queensland Reconstruction Authority, as fully reimbursable to Council under the Resilient Homes Fund. In the process of Council receiving any information relating to the purchase and compulsory acquisition of the properties listed in confidential attachment 1, Council becomes aware that additional expenditure or risk of any kind, may be potentially incurred by Council, (above the ordinary expenditure of the purchase and compulsory acquisition of land by Council) and which is not fully reimbursable under the Resilient Homes Fund, to the satisfaction of Council, then the recommendations contained in paragraphs A-D of this report are automatically repealed.

F. That Council resolve to authorise the Chief Executive Officer to take the necessary action in order to implement Council’s decision, including but not limited to making, amending and discharging contractual arrangements.

G. That Council be kept informed as to the progress and outcome of the purchases/acquisitions.
